A US court in Texas issued a temporary order on Friday. The court sided with women and doctors who filed a lawsuit challenging the state’s abortion restrictions.
In her written ruling, Judge Jessica Mangrum agreed that Texas’s abortion restrictions caused women to “delay access to abortion care or deny doctors treatment out of fear.” In 2006, she ordered that doctors could not be prosecuted for exercising their “good faith judgment.” The court temporarily lifted a ban on emergency abortions.
Seeing The Medical Emergency, Doctors Will Have To Take A Decision
The case, filed by the Center for Reproductive Rights, argues that the way medical exceptions are defined in Texas laws is confusing. They are creating fear among doctors and creating a “health crisis”. During the hearing, the judge said that the doctors should be allowed to determine their feelings. What medical emergencies could endanger a woman’s “life and health (including fertility)”?
Hearing On Amanda Zurawski’s Case
According to media reports, the court last month heard testimony from Amanda Zurawski, who said she was denied an abortion despite her water breaking very early in the pregnancy, which meant an abortion was necessary. Zurawski told the court that the doctor did not treat him because of fear, due to which the fetus was born dead.
Last year, the Texas Supreme Court maintained a lower court order that said clinics could continue performing abortions. After this court decision, clinics in Texas, with a population of about three crores, stopped performing abortions.
