Customer Will Get Compensation

In an order passed last month, the District Consumer Disputes Redressal Commission (DCDRC) Mumbai said the order was cancelled deliberately to earn extra profits. The detailed order was made available on Sunday. The Commission said that although the customer had received a refund, he should be compensated for the mental agony caused to the customer due to the arbitrary cancellation of the order.

Paid Rs 39,628 Through Credit Card

According to the complainant, a resident of Dadar, he ordered an iPhone from Flipkart on July 10, 2022, and paid Rs 39,628 through a credit card. The phone was to be delivered on July 12, but six days later, an SMS was received from e-commerce company Flipkart cancelling the order. When contacted, the company said that the delivery boy had made several attempts to deliver the phone, but the complainant was unavailable, so the order was cancelled.

The complainant said that he suffered mental harassment due to the cancellation of the order. In its written reply, Flipkart said that the complainant considered it the product’s seller. However, it only works as an intermediary and an online platform. All products on the Platform are sold and supplied by third-party sellers. The seller was an International Value Retail Private Limited Company in this case.

Flipkart had no role in the entire transaction between the complainant and the seller. Flipkart claimed that it had informed the seller about the complainant’s complaint. The seller said the delivery boy had made several attempts to deliver the phone to the address, but the complainant was unavailable, so the order was cancelled. The money has been refunded.

Flipkart Accepted That The Order Was Canceled

However, the Commission said the e-commerce company unilaterally cancelled the order. Flipkart did not provide any evidence for its or the seller’s claims about multiple attempts to deliver the phone. The Commission said Flipkart had admitted that the order was cancelled, and the complainant was asked to place a fresh order.

Did This To Earn Extra Profit

It is alleged that the cost of the iPhone had increased by approximately Rs 7,000, so the order was cancelled, and a fresh order was requested to be placed. The Commission stated that Flipkart had done this deliberately to earn additional profits, which amounts to unfair and restrictive trade practices. The Commission ordered Flipkart to pay Rs 10,000 as compensation for the mental harassment caused to the complainant.
