Hearing on this whole matter, the bench of Justice SK Kaul and Justice Ahsanuddin Amanullah said on Friday that it would not be appropriate for this court to issue a writ of mandamus in a petition under Article 32 of the Constitution. The government has to decide on this issue, considering senior citizens’ needs and the fiscal consequences. Rejecting the argument of petitioner MK Balakrishnan, the bench said that the state must give concessions to older people.
Indian Railways gave 40 per cent concession in fare to male passengers of 60 years or above and 50 per cent fare to female passengers above 58 years of age.
